This Service Agreement ("Agreement") is entered into between AMALA Finance ("AMALA") and the business owner ("Business Owner"), collectively referred to as the "Parties."
1. Purpose
AMALA Finance provides businesses with access to financing solutions designed to help their clients secure funding with flexible payment options. This Agreement outlines the terms under which the Business Owner will use AMALA Finance to facilitate financing for clients.
Through AMALA Finance, Business Owners gain access to:
1. A platform that simplifies finance applications in Australia.
2. Support to help their clients access funding options more confidently.
3. Business resources and community support to increase sales and reinvest effectively.
This Agreement ensures a clear and structured relationship between AMALA Finance and the Business Owner.
2. Fees & Payment Terms
The Business Owner agrees to the following:
1. A $495 AUD one time activation and set up fee.
2. A $97 USD monthly subscription fee starting after 60 days (2months) of using the service for continued access to the platform, resources, and community
All payments must be made in full each month.
Failure to pay may result in suspension or termination of platform access.
3. AMALA Responsibilitie
AMALA Finance will:
1. Provide access to its finance platform and resources.
2. Process finance applications efficiently and in compliance with regulations.
3. Ensure timely processing of all approved finance applications.
4. Maintain confidentiality of client and business owner information.
5. Provide platform updates and notify the Business Owner of any significant changes.
6. Moderate the AMALA community to maintain a professional and supportive environment.
4. Business Owner Responsibilities
The Business Owner agrees to:
1. Use the AMALA platform ethically and in compliance with community guidelines.
2. Ensure all referred clients meet AMALA’s qualification criteria.
3. Provide accurate and complete client information.
4. Abide by all legal and compliance requirements associated with offering finance.
5. Maintain confidentiality of any proprietary information provided by AMALA.
6. Act professionally and respectfully within the AMALA community.
7. Follow AMALA’s policies on ethical conduct, non-solicitation, and communication standards.
5. Platform & Community Guidelines
By using AMALA, the Business Owner agrees to:
1. Engage in ethical and professional conduct at all times.
2. Avoid making misleading statements or promises about financing options.
3. Refrain from soliciting or promoting external services that compete with AMALA.
4. Respect all other members within the AMALA network.
5. Utilize the platform solely for approved business activities.
6. Non-compliance may result in warnings, suspension, or permanent removal from the platform.
6. Termination
Either party may terminate this Agreement with 30 days’ written notice.
AMALA reserves the right to suspend or terminate access immediately if there is a breach of contract, failure to pay fees, or misconduct.
No refunds will be provided for subscription fees if termination occurs due to a breach of terms.
7. Disclaimer
AMALA Finance provides access to financing solutions, training, and a supportive community but does not guarantee specific funding approvals or business outcomes. The Business Owner is responsible for ensuring compliance with all applicable laws and regulations in their region.
This Agreement represents the full understanding between the Parties and supersedes any prior agreements.
This Refund & Cancellation Policy applies to all Business Owners subscribed to the AMALA platform and using its services.
1. Refund Policy
- No refunds will be processed once the subscription has been charged.
- It is the responsibility of the Business Owner to ensure cancellation is submitted before the next billing cycle to avoid renewal.
- Subscription fees are paid directly to the platform provider and are non-recoverable once processed.
2. Cancellation Notice Requirements
- Cancellations must be submitted in writing via email to AMALA support.
- A 7-day written notice is required before the next subscription billing cycle.
- Failure to provide notice will result in the next billing cycle being charged as scheduled, with no refund.
3. Platform Access Post-Cancellation
- Upon cancellation, access to the AMALA platform, community, and tools will be revoked after the final billing cycle.
- Any confidential or proprietary information obtained through the platform must continue to be handled in accordance with Section 4 of the Service Agreement.
4. Dispute Resolution
- Any disputes regarding payments, refunds, or service fees must first be submitted in writing to AMALA support.
- AMALA is committed to working in good faith with Business Owners to resolve concerns promptly and fairly.
Disputes should not be escalated to third-party payment platforms unless all internal resolution avenues have been exhausted.
